1. Acceptance of Terms

By accessing or using the Modern Genius Dashboard platform at mymoderngenius.com (the "Service"), operated by Modern Genius ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Modern Genius Dashboard is a scheduling and payments platform that connects tutors with their students. The Service allows tutors to set availability, define session types, and receive payments. Students can browse available sessions, book tutoring appointments, and make payments through the platform.

3. Accounts

• You must sign in using a valid Google account or verified email address to use the Service.
• You are responsible for maintaining the security of your account.
• You must provide accurate and complete information.
• You may not use the Service for any illegal or unauthorized purpose.
• Account access is by invitation only for students. Tutor accounts require approval.

4. Payments and Fees

• All payments are processed securely through Stripe.
• Tutors set their own session prices. Modern Genius collects a platform fee on each transaction.
• Students are charged at the time of booking.
• Refunds for cancelled sessions are processed according to the cancellation policy. Sessions cancelled before the scheduled start time are eligible for a full refund.
• Tutors are responsible for any applicable taxes on their earnings.

5. Tutor Responsibilities

• Tutors are responsible for accurately setting their availability and session types.
• Tutors must honor booked sessions or cancel with reasonable notice.
• Tutors must complete Stripe Connect onboarding to receive payments.
• Tutors are independent service providers, not employees of Modern Genius.

6. Student Responsibilities

• Students must attend booked sessions or cancel in advance.
• Students are responsible for ensuring their payment method is valid.
• For students under 18, a parent or guardian is responsible for their account and use of the Service.

7. Google Calendar Integration

The Service integrates with Google Calendar to check for scheduling conflicts and create calendar events for booked sessions. By granting calendar access, you authorize us to read your calendar events (to check availability) and create events on your behalf. You can revoke this access at any time through your Google Account settings.

8. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by Modern Genius and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

9. Limitation of Liability

Modern Genius provides the Service "as is" without warranties of any kind. We are not liable for the quality of tutoring services provided through the platform. To the fullest extent permitted by law, Modern Genius shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

10. Termination

We may suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the platform. You may request account deletion at any time by contacting us.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
